“Personal Information” may include any Personal Information, such as your name, address, IP address, mailing address, contact information, email address, location (including that derived from GPS or geolocation technology through the use of the FITREP App), payment information (including credit card number, expiry date and CVV number) or phone number and other information you may submit through any of the Fitness Republic’s Services. For example, if you create an account for the FITREP App, or sign up to receive Fitness Republic newsletters, or submit blog posts to Fitness Republic, may request and you may be required to provide Personal Information, including, without limitation, your e-mail address. While the Personal Information we collect may come directly from you, it may also be provided by our affiliates or other third parties, including the fitness service providers with whom you book appointments using the FITREP App.
When you provide Personal Information to us, in any way or through any medium (e.g. customer service, FITREP App, Website, etc.), you are consenting to the manner in which Company may collect, use, disclose and otherwise manage your Personal Information, which is set forth herein.
Permission to Use This Website . The Website is not intended or designed to be used by anyone under the age of 13. Company does not collect Personal Information from any person it knows to be under the age of 13. If you are under 13, DO NOT USE THIS WEBSITE AND DO NOT SEND ANY PERSONAL INFORMATION. IF YOU ARE BETWEEN THE AGES OF 13 AND 17, DO NOT USE THIS WEBSITE UNLESS YOU ARE SUPERVISED BY A PARENT/GUARDIAN OR HAVE RECEIVED PERMISSION FROM YOUR PARENT/GUARDIAN.
The FITREP App is not intended or designed to be used by anyone under the age of 18 (please refer to the Terms and Conditions of Use).
DO NOT SEND US INFORMATION UNLESS YOU CONSENT TO THE APPLICATION OF CANADIAN AND U.S. LAW AND TO THE USE AND DISCLOSURE OF YOUR INFORMATION CONSISTENT WITH THIS PRIVACY STATEMENT.
If you wish to access your Personal Information, or request that your Personal Information be removed from our database, you may contact our Privacy Officer as outlined below. Fitness Republic will provide access to this information, correct any factual inaccuracies identified, and remove information as requested. We may be unable to remove information to the extent that it is permitted or required to be retained by applicable law or document retention and data backup policies, or if removal is not practicable due to technological reasons. Removal of your Personal Information may prevent us from providing further services and information to you. We may charge you a small fee to process your request to receive such information. The fee we charge will not exceed any limit set by Applicable Laws. If you would like a copy of some or all of such information, please contact us. You may ask us to correct or remove information about you that you think is inaccurate by contacting us.
We may collect Personal Information that you provide us when you undertake any of the following: complete or update a profile with us (whether to use the FITREP App or otherwise); communicate with us for any reason; purchase, order, return, exchange or request certain information about our products and Services; contact us; register for and use our Services (including the FITREP App, including makings Bookings, cancelling same, submitting comments, communicating with fitness service providers, etc.) or participate in another feature of our Services, that requires your Personal Information; or when you provide us with comments, suggestions or content for social media or blog posts. Such Personal Information may include your name, gender, contact details, date of birth, any information that is publicly available as part of your Facebook profile, location from your mobile devise using GSP technology, and payment information; when we would like to inform you of products and Services, sales and special offers that might benefit you. Personal Information may also include any health or personal data or images that you choose to share either with Fitness Republic or service providers with whom you engage through the FITREP App.
We may also collect Personal Information about you from our third party service providers who provide fitness delivery service, e-commerce and/or technical related associated with functionality and purposes of our Services. We may ask fitness Service Providers to provide us with feedback and an overall score in relation to your condition, strength, endurance and performance during the Booking with the FITREP App. Such information may include sensitive personal data (for example, about health and fitness) about you (and is considered Personal Information under this Policy).
We may also collect data about your location from your Device using GPS technology (“Location Data”). Location Data helps the FITREP App identify your location in order to help you make a Booking, or if you are a Service Provider to help us match you to Bookings based on your location. We will ask for your consent prior to collecting Location Data from you. You may withdraw such consent at any time by disabling the App’s access to your location using the settings within your Device or the App. If you do not give consent or withdraw it, you will still be able to use the App by manually identifying your location. We work closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, analytics providers, search information providers and credit reference agencies) and may receive information about you from them.
We may also automatically collect your IP address or other unique identifier for the Device you use to access the Services, including the FITREP App. A unique identifier is a number that is automatically assigned to your Device when you access a website, app or its servers, and we can identify your Device by this number (“Device Identifier”). Some mobile service providers may also provide us with the physical location of the Device used to access the Sites.
If you are a fitness Service Provider, then following each Booking we ask the relevant user or client to provide a rating and comments about you and the Service Provider Services you provided.
Company also uses Personal Information to continually assess and improve the Services and products we offer. To serve you better, we may combine the Personal Information that you give us with publicly available information and information we receive from or cross-reference with our marketing partners and others.
Fitness Republic may also collect, use and disclose Personal Information you provide in order to contact you; respond to your inquiries and provide you with relevant information from time to time; provide services and products requested by you; administer or otherwise carry out our obligations in relation to any agreement you have with us; bill for services and products provided to you for which there is a charge; compile statistics for analytical and marketing purposes, and any other purposes which we inform you about when we ask you for information.
The FITREP App may ask you to input payment information (including credit card number, expiry date and CVV number) if you want to make a Booking. This information is collected directly by our third party payment processor, which uses such information to process payment from you. FITREP itself does not have access to this information. If you have already provided your payment details through the App and attempt to make another Booking, we ask our third party payment processor for details of the payment method(s) you provided previously so that you do not have to enter them again. These details are only partially made available to us (for example, we only see the last four digits of your payment card number), meaning that we never have access to your complete payment details. The App will then display such details to you so that you may use them to make another Booking.
In addition to the purposes indicated above, Fitness Republic may use Personal Information to provide other products, services and information that users request, to contact users in connection with Fitness Republic’s events, news and other activities, and to provide users with additional information about events, products and services in which they might be interested. If you do not want your Personal Information used for these purposes, you may opt out by contacting our Privacy Officer as outlined below under Personal Information: Access and Correction.
Particular use, collection and sharing of Personal Information relating to the FITREP App
In addition to the other uses and collection of Personal Information set out in this Policy, we note the following additional items which are relevant to your use of the FITREP App.
We may share your Personal Information with any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries Fitness Republic Inc. We may also share your information with third parties in the following circumstances:
When a Booking is made: When you make a Booking using the App, we will share information about you with the relevant fitness Service Provider so that the requested Service Provider Service can be provided, including your name, gender, your mobile telephone number, details of the Service Provider Service you have requested, the Appointment Time, the location where the Booking will take place, any information which is available as part of your profile on the App (including any sensitive personal data you have chosen to provide (for example, relevant information about your health and fitness) and your photograph), your age-range, and details of your average score and performance history if you have made previous Bookings.
If you are a Service Provider, we will share information about you with Users including your full name, gender, any information available on your profile within the App and your photograph. We will also share your mobile telephone number to any User who makes a Booking with you. When there is a complaint about a Booking: In the unlikely event that you have a complaint in relation to a Booking, we may also share some or all of the following information with the Service Provider (as applicable to the nature of your complaint): your name, your mobile telephone number, your email address, details of the Service Provider Service you requested, the Appointment Time and location for the Booking, and/or details of your complaint (which may include any relevant sensitive personal data that you have chosen to provide).
If you are a Service Provider we may share with the User who has made the complaint any information we hold about you which we consider to be relevant to the complaint.
Ratings, comments, submissions, feedback and scores: If you provide a rating and/or comments about a Service Provider, we may share such rating and/or comments with the Service Provider. If you are a Service Provider, we may also share the feedback and overall score you provide about a User who has made a Booking with the relevant User.
Legal and other disclosures: We may transfer and disclose information about you (which may include sensitive personal data we hold about you, if reasonably required) to third parties if: (i) we sell or buy any business or assets, in which case we may disclose information about you to the prospective seller or buyer of such business or assets; (ii) Fitness Republic or substantially all of its assets are acquired by a third party, in which case information held by it about Users will be one of the transferred assets; (iii) We are under a duty to disclose or share information about you in order to comply with Applicable Laws or a lawful request from any governmental or regulatory authority; in order to enforce or apply the Terms or any other agreement between you and Fitness Republic; to investigate potential breaches of such Terms or other agreement(s); or to protect the rights, property, safety and/or security of Fitness Republic or of any third party (including other Users and Service Providers). This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
Privacy Preferences / Opt-Out. If you wish to Opt-Out from any of the aforementioned uses of Personal Information, except in the case of Legal Proceedings, please contact us via email at firstname.lastname@example.org Your subsequent disclosure of Personal Information nullifies any prior Opt-Out request.
Third Party Access to Personal Information. Some of our operations, such as fitness delivery services, website administration, technical support, and/or electronic commerce, may be managed by third parties unaffiliated with Company. These companies may share Personal Information with their affiliates and with service providers whom they engage to perform services related to our products and Services or the operation of our business.
Legal Proceedings. If Company or any of our service providers is requested by law enforcement officials or judicial authorities to provide Personal Information on individual users, Company or the applicable service provider may, without your consent, provide such information. In matters involving claims of personal or public safety, Company or the applicable service provider may provide your Personal Information to appropriate authorities without your consent or court process. Company or our Service Providers also will provide your Personal Information in response to a search warrant or other legally valid inquiry or order, or to an investigative body in the case of a breach of an agreement or contravention of law, or in litigation involving Company, the applicable service provider, or otherwise as required by law. We may also disclose Personal Information to assist in debt collection where you owe a debt to us.
Cookies & Related Technologies. Our Services uses “cookies” and related technologies such as API keys and tokens to distinguish you from other users of the Services. This helps us to provide you with a better experience when you use the Services and to improve our Services. Cookies and related technologies are small bits of text that are downloaded to your mobile device or Web browser and then stored on your hard drive, when you use our Services. Your mobile device and Web browsers sends these bits of text back to our Services every time you visit, so it can recognise you and tailor what you see on the screen.
We use API tokens and keys in our Services to: identify and remember your Login so that you do not need to re-enter your Login every time you use the Services; and analyse and improve your experience of the Services, for example to determine what pages, features and links are popular and which ones don’t get used so much, which helps us keep the Services relevant and up to date.
Security. We maintain reasonable administrative, technical and physical safeguards to protect against unauthorized access, use, modification and disclosure of Personal Information in our custody and control. We also are committed to employing reasonable technology in order to protect the security of our Services. However, even with the best technology, no Service is 100% secure.
Outside Links. This Privacy Statement only applies to the Services. The Services may include links to the websites of our business partners, vendors and advertisers. These other sites are outside of our control. Please be aware that these websites may collect information about you, and operate according to their own privacy practices which may differ from those contained in our Privacy Statement.
Modification to Privacy Statement. From time to time we may modify or amend this Privacy Statement in order to comply with new laws or regulations or to reflect future changes in our business practices. Any changes in our policies will be communicated in this page so please check back on occasion.
Fitness Republic uses appropriate physical, organizational and technological measures to protect the Personal Information you provide to us against loss or theft, and unauthorized access, disclosure, copying, use, or modification. This includes limiting access on a “need-to- know” basis. However, no electronic data transmission can be guaranteed to be secure from access by unintended recipients and Fitness Republic will not be responsible for any breach of security unless this breach is due to its negligence.
